New Balance Athletic Shoes (U.K.) Limited is a company registered in England and Wales under company number 01616165 with its registered office at Appleton House 430 Birchwood Boulevard, Birchwood, Warrington, Cheshire, WA3 7WD (“New Balance” or "we/us/our")). New Balance owns and operates the website at.newbalance.eu (the “Website”).
These Terms and Conditions (these “Terms”) set out the terms and conditions which apply to physical gift cards purchased from New Balance stores in Austria and electronic gift cards or e-gift cards purchased online from the Website (together the “Gift Cards”).
Please read these Terms carefully before you purchase a Gift Card. By purchasing and/or using a Gift Card, you confirm that you accept these Terms and that you agree to comply with them.
General
1.Gift Cards are available in increments of 25€ -250€
2. eGift Cards include a personal message and are sent to the recipient's email address as soon as possible after payment is processed.
3. We are unable to ship separate items to multiple addresses. eGift Card purchases are processed separately from other items in your shopping cart on our Website and your order confirmation is your receipt.
4. Your order for a Gift Card on our Website constitutes an offer to us. All orders are conditional upon acceptance by us which shall be confirmed by email to you once payment has been made by you for the Gift Card.
5. Your purchase of a Gift Card is for personal use only and shall not be for commercial use or resale under any circumstances.
6. Gift Cards cannot be exchanged for cash or credit. We do not give change or refunds on Gift Cards.
7. Gift Cards are valid for a period of 5 years from the date of purchase.
8. Gift Cards remain the property of New Balance.
9. New Balance may amend these Terms at any time by amending this page on our Website without notice to you. Your continued use of this Website and any purchase of Gift Cards from the Website or from our stores constitutes an agreement by you to be bound by the amended terms.
Redeeming Gift Cards
10. Gift Cards are redeemable for merchandise at at.newbalance.eu and participating New Balance stores in Austria. Gift Cards may be applied to orders placed online or at participating New Balance stores in Austria. Simply enter the Gift Card code during checkout or present the Gift Card to the store associate at a participating New Balance store. If the amount of your Gift Card exceeds the order total, the balance will remain active for later use subject to the expiry period set out above.
11. Gift Cards can be used as many times and for as many purchases as you choose until the total balance of the Gift Card has been spent subject to our expiry period set out above.
12. Upon redemption, any unused balance on a Gift Card will be carried over for future purchases (prior to the expiry date) and may not be redeemed or exchanged for cash or credit and any unused balance is non-refundable. If the purchase total exceeds the Gift Card amount, the difference must be paid in full using a debit/credit card or other valid means.
13. All purchases made with Gift Cards on our Website are subject to acceptance of our terms of sale for online purchases. You acknowledge that you have read and accept such terms of sale and agree to comply with them.

Lost or Stolen Gift Cards
15. Gift Cards should be treated like cash. They will not be replaced if lost, stolen, damaged or destroyed. We are not responsible if any Gift Card is lost, stolen, damaged, destroyed or used without permission.
Returning Items Purchased With a Gift Card
16. If you need to return an item purchased with a Gift Card, the refund amount will be added to the original Gift Card or we may need to issue a new Gift Card in certain circumstances. If your return was purchased with an eGift Card, we will email you a new eGift Card valued at the refund amount.
Consumer Right of Withdrawal / Cancellation
17. You have the right to withdraw from the purchase of an eGift Card only which you purchased on our Website or on any New Balance platform without giving any reason within 14 days of receipt of the eGift Card (the “Period”) provided that you have not used the eGift Card.
18. To exercise your right of withdrawal / cancellation of your purchase of an eGift Card, you must inform us of your decision to do so within the Period by contacting our Customer Services Department at Contact us with a statement that you wish to withdraw or cancel your purchase of the eGift Card.
19. In case of withdrawal / cancellation, New Balance will refund the amount of the eGift Card to the original payment method used during ordering within 14 days of the date of the notice of withdrawal / cancellation. You must provide us with proof of purchase to enable us to refund the amount of the eGift Card. Refunds will only be issued to the person who purchased the eGift Card and not to the recipient of the eGift Card if a different person.
20. A Gift Card purchased at a New Balance Store (i.e. a ‘bricks and mortar’ store) cannot be returned even if it has not been used.
Fraud
21. We reserve the right without notice to you to void a Gift Card or refuse to accept a Gift Card which we consider may have been issued with the incorrect denomination; have been tampered with; duplicated; and/or which otherwise is suspected to be affected by fraud. We may also void a Gift Card or refuse to accept a Gift Card in the event you breach any of the Terms. For the avoidance of doubt, no refund shall be issued to you in either of these circumstances.
Liability
22. Our liability is limited to you as set out in these Terms.
23. Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; and (iii) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
24. Save as set out in clause 23, our maximum liability to you under these Terms in respect of any Gift Card purchased by you from New Balance under these Terms will be limited to the value of that particular Gift Card.
25. You are solely responsible for providing the correct email address for the recipient of a Gift Card. In the event that any incorrect details are provided for the recipient of a Gift Card, and we are unable to process and deliver a Gift Card as a result, we are not responsible for any losses incurred by you and/or the recipient in such circumstances.
Governing Law
26. These Terms are applicable to the extent permitted by law.
27. Except and solely to the extent where prohibited and without limitation to any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence, you agree that the construction, validity and performance of these Terms is governed by English law and that the courts of England will have exclusive jurisdiction over any claim arising out of or in connection with these Terms.
